Welcome to fly.email. By using our service, you agree to the following Terms of Service. Please read them carefully before creating an account or sending any email.
1. Overview
fly.email ("the Service," "we," or "us") provides a personal email platform that allows users to send and receive personal and professional emails using their own verified domains and email addresses. Our platform is designed for individual use, not for marketing, bulk email, or spam.
2. Acceptable Use
You agree to use the Service only for lawful and responsible purposes.
You may not use the Service to:
- Send unsolicited bulk or promotional email ("spam").
- Send to more than 10 recipients per email without prior approval from us.
- Use purchased, rented, or harvested email lists.
- Send chain letters, automated messages, or mass marketing campaigns.
- Transmit harmful or illegal content, including malware, phishing, or fraudulent material.
- Misrepresent your identity or impersonate another individual or organization.
We may increase the per-email recipient limit only on a case-by-case basis for legitimate personal communication.
3. Account and Identity Verification
To maintain platform integrity and compliance with AWS SES requirements:
- All users must verify their email address and domain ownership before sending.
- You must provide accurate and truthful information during registration.
- Accounts found using unverified or spoofed email addresses will be suspended or terminated.
4. Sending Policies
- Each user is responsible for the content they send.
- The Service automatically monitors sending behavior to prevent abuse.
- We may limit, delay, or suspend sending if abnormal or high-risk activity is detected.
- Users agree to comply with all applicable email laws (CAN-SPAM, GDPR, etc.).
5. Bounce and Complaint Handling
We automatically process bounces and complaints through Amazon SES:
- Hard bounces and complaints result in immediate suppression of the recipient address.
- Repeat offenders or accounts generating excessive bounces or complaints may be suspended.
- Users are notified when their email fails to deliver or is marked as spam.
6. Privacy
We respect your privacy.
- We do not sell or share your data with third parties.
- Email content is stored and transmitted securely using encryption.
- We may log metadata (timestamps, delivery status, bounce notifications) for compliance and deliverability management.

7. Enforcement and Termination
We reserve the right to:
- Suspend or terminate accounts violating these terms.
- Remove any content that violates laws or policies.
- Report unlawful activity to authorities if necessary.
Continued use of the Service indicates acceptance of any updated Terms of Service.
8. Liability
We provide the Service "as is" without warranty. We are not responsible for:
- Delivery delays or failures caused by external providers (e.g., mail servers, ISPs).
- Damages arising from misuse or unauthorized access to your account.
Your use of the Service is at your own risk.

10. Eligibility and Age Requirements
You must be old enough to manage your own online account in your country or have verifiable consent from a parent or legal guardian. If you allow a minor to use the Service, you are responsible for their activity.
11. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use or suspected breach. We may require multi‑factor authentication.
12. Your Content and License to Us
You retain ownership of the content you send or store through the Service. To operate and improve the Service (including delivery, routing, storage, spam and abuse prevention, security, and product features), you grant us a limited, worldwide, non‑exclusive, royalty‑free license to host, transmit, process, and display your content. This license is solely for operating and improving the Service and ends when your content is deleted from our systems, subject to:
- reasonable backup retention and archival logs,
- legal retention obligations, and
- suppression records needed to honor opt‑outs, bounces, and complaints.
We do not sell your content or use it for advertising.
13. Software and Updates
Any software we provide is licensed, not sold, and may update automatically. You may not copy, modify, reverse engineer, or redistribute the software except as permitted by law.
14. Third‑Party Services
The Service integrates third parties such as Amazon Web Services (e.g., Amazon SES) and DNS/email security providers. Your use of those services may be subject to their terms. We are not responsible for third‑party outages or actions.
15. Service Changes, Availability, and Beta Features
We may add or remove features, impose new limits, or discontinue parts of the Service. If we discontinue a material feature, we will give reasonable advance notice when practical. Beta or pre‑release features are provided as‑is and may change or be withdrawn at any time.
16. Fees (If Applicable)
If we offer paid plans, we will clearly disclose pricing and billing terms. Taxes, if any, are your responsibility. Except where required by law, fees are non‑refundable once service is rendered.
17. Intellectual Property
We and our licensors retain all rights in the Service, including software, user interfaces, and branding. These Terms do not grant you any rights to our trademarks or logos.
18. Copyright and IP Complaints
If you believe content sent through the Service infringes your rights, send a detailed notice to hey@dak.dev. We may remove or disable access to content, terminate repeat infringers, and notify affected users.
19. Export Controls and Sanctions Compliance
You may not use the Service if you are located in, or are a resident of, a country or region subject to comprehensive U.S. sanctions, or if you are on a U.S. government denied‑party list. You agree to comply with applicable export control and sanctions laws.
20. Business or Organization Use
If you create or administer accounts on behalf of a business or organization, you represent that you have authority to bind that entity, and that entity accepts these Terms. The organization is responsible for its users' compliance.
21. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, by email or in‑product notification). Your continued use after the effective date constitutes acceptance.
22. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant uninterrupted or error‑free operation.
23. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us in the 12 months before the claim arose, or (b) $100.
24. Indemnification
You will indemnify and hold harmless fly.email and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, or your violation of these Terms or applicable law.
25. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. The courts located in San Mateo County, California will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
26. Communications and Notices
We may contact you via the email address associated with your account or through in‑product notifications. You agree to keep your contact information current.
27. Miscellaneous
If any provision is found unenforceable, the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and us regarding the Service and supersede prior or contemporaneous agreements on the same subject. Our failure to enforce a provision is not a waiver.
